Terms and conditions (T&C) for Football Legacy

These terms govern the use of the Football Legacy browser game and all related services.

1. Scope and provider

(1) These terms and conditions ("Terms") govern the use of the Football Legacy browser game ("Game") and the related services.

(2) Provider and contracting party: Johannes Haller, Nobistor 16, 22767 Hamburg, Email: johanneshaller96@gmail.com.

(3) Deviating, conflicting, or supplementary terms of users do not become part of the contract unless the provider expressly agrees to them.

2. Subject of the contract

(1) The provider offers a browser game in which users can create and manage fictional clubs and interact with other users.

(2) The game is currently free. The provider may offer additional paid features in the future. Users will be informed before use.

(3) There is no claim to a specific set of features or permanent availability. The provider may change or discontinue content as long as reasonable.

3. Registration and user account

(1) Certain features require registration with a username and valid email address.

(2) Information must be truthful; multiple accounts are prohibited.

(3) Access credentials must be kept confidential. The provider must be informed if misuse is suspected.

(4) The service can generally be used by persons of any age. Users below the age of majority must ensure they are permitted to use the service under the law of their residence.

4. Services and availability

(1) The provider owes the provision of the game in its current version within technical possibilities.

(2) Maintenance, updates, or adjustments may temporarily limit availability. Planned work is typically carried out during low-usage periods.

(3) The provider is not liable for outages outside its control (e.g. internet disruptions or user hardware issues).

5. Use of the game

(1) Users receive a simple, non-transferable right to use the game for private entertainment purposes.

(2) Commercial use (e.g. account sales, external advertising) requires prior consent from the provider.

6. User-generated content (club names, logos, etc.)

(1) Users may create or upload content such as club names, logos, graphics, and texts.

(2) Users are solely responsible for such content and guarantee not to infringe third-party rights (trademarks, copyrights, personality rights, etc.).

(3) The use of real club names, logos, or other protected signs without authorization is prohibited.

(4) The provider does not review content in advance and assumes no liability for legal violations by users.

(5) Users indemnify the provider against third-party claims arising from their content, including reasonable legal defense costs.

7. Grant of usage rights to user content

(1) Users grant the provider a simple, worldwide, royalty-free right to use their content for storage, adaptation, and display in the game, as well as for use in screenshots, trailers, or marketing materials.

(2) The usage right applies for the duration of the user account and beyond as needed to document or present the development of the game.

(3) The user warrants that they are entitled to grant these rights.

8. Rules of conduct and prohibited content

(1) Users must behave respectfully and comply with applicable laws.

(2) Prohibited content includes insulting, discriminatory, racist, glorifying violence, pornographic, harmful-to-minors, or otherwise illegal content, spam, malware, unauthorized advertising, hacking, bot usage, or scraping of third-party data.

(3) In case of violations, the provider may delete content, warn users, suspend accounts, or permanently ban users.

9. Multiple accounts, manipulation, and security violations

(1) Multiple accounts are prohibited.

(2) Manipulation, security breaches, or unauthorized access to third-party accounts are forbidden.

(3) In severe cases, the provider may ban users for life and delete data where legally permissible. Criminal acts may be reported to authorities.

10. Paid features / in-game purchases

(1) Football Legacy is currently free. Future paid features will be clearly marked and will not increase sporting success ("no pay-to-win").

(2) Before purchasing paid content, users will be informed about price, term, cancellation, and withdrawal. Charges only occur after explicit consent.

(3) Detailed rules for paid services will be added once they are available.

11. Liability

(1) The provider is liable without limitation for intent, gross negligence, injury to life, body or health, and under the Product Liability Act.

(2) In cases of slight negligence, the provider is liable only for breach of essential contractual obligations; liability is limited to foreseeable damages.

(3) Any further liability is excluded. This also applies to employees, representatives, and agents.

12. Indemnification

Users indemnify the provider against third-party claims arising from unlawful use or rights violations caused by user content. The indemnification includes reasonable legal defense costs. Users support the provider in defending against such claims.

13. Term and termination

(1) The user agreement is concluded for an indefinite period.

(2) Users can terminate their account at any time using the provided functions or by email.

(3) The provider may terminate for good cause with appropriate notice or discontinue the game.

(4) Termination without notice for good cause (e.g. severe violations) remains reserved.

14. Changes to the terms

(1) The provider may amend these terms for objective reasons (e.g. legal changes, feature adjustments).

(2) Users will be informed of material changes. If they do not object within a deadline or continue to use the game, the changes are deemed accepted.

(3) In case of objection, the provider may terminate the user agreement.

15. Final provisions

(1) German law applies. Mandatory consumer protection provisions of the user residence state remain unaffected.

(2) If a provision is invalid, the rest of the agreement remains effective.
